TNT Express affected by the extraterritorial application of the embargo against Cuba
New York, 23 May 2016. TNT Österreich, an affiliate in Austria of TNT Express N.V. (Netherlands) joins the list of companies affected by the extraterritorial character of the economic, commercial and financial blockade imposed by the United States against Cuba.
TNT Österreich notified the Embassy of Cuba in Austria of the definitive suspension of the international mail services that it usually provided to the diplomatic mission.
The company argued that it had been taken over by FedEx Corporation headquartered in the United States. Consequently, and “based on the established guidelines” – by the United States- TNT could not take any further service request from Cuba or any other country subject to the United States sanctions.
The cancelled mail services offered by TNT were related to consular procedures. This TNT decision affects the consular services offered by the diplomatic mission to Austrian, Croatian and Slovenian citizens, as well as the Cuban community residing in such countries.
The application of such coercive and unilateral measures against Cuba is illegal in the territories of Austria and the European Union in general. On 22 November 1996, the European Council adopted Regulation (EC) No. 2271/1996 “protecting against the effects of the extra-territorial application of legislation adopted by a third country, and actions based thereon or resulting therefrom.” By virtue of this Regulation, the Austrian Parliament adopted Act 117/1997 on 22 October 1997.
This fact is once again evidence of the validity, extent and scope of the extraterritorial blockade on Cuba, which ignores the virtually unanimous rejection of the international community. The consequences of this unilateral policy are not only limited to the Cuban people. It also brings significant damages to third countries’ natural and legal persons.
